Statement of Nickolaus Theis

     In the name of God, Amen, I Nickolaus Theis, of the Town of Benton, in the County of Carver, and State of Minnesota, at the age of Sixty three Years, and being of sound mind and memory, do make, publish and declare this my last will and testament, in manner following, that is to say:

     First, I give my loved wife Eva Theis, the whole of my money, and all the notes which be promised to my name, Nickolaus Theis, which she shall receive instead of her Dower.
     further, After my wife's decease, then the remaining money shall be divided to my beloved children; the only exception I make is John Sontheim, who shall have one white and one red spotted cows, together with three calves; and one red heifer calf, and one red and white spotted heifer calf, Also, I give my son-in-law John Morbacher two cows, together with one black and brown with the calves. Also, my son Daniel Theis shall have my cow and calf.

In witness whereof, I have hereunto set my hand and seal, this 20th day of May A.D. 1858.
